Summary: By using AllFans Platform you agree to these Terms. If you do not agree, please do not use our platform. These Terms form a legally binding agreement between you and AllFans Platform.
By accessing or using allfansplatform.com (the "Platform"), you confirm that you are at least 18 years of age, have read and understood these Terms of Service ("Terms"), and agree to be bound by them. If you are using the Platform on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
AllFans Platform ("AllFans", "we", "us", or "our") reserves the right to update these Terms at any time. We will notify registered users of material changes by email or by posting a notice on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.
You must be at least 18 years old to create an account or use any part of the Platform. By registering, you represent and warrant that you meet this age requirement. We reserve the right to verify age and to terminate accounts where this requirement is not met.
The Platform is not available to persons who have previously been suspended or removed from the Platform, or to persons located in jurisdictions where access to the Platform is prohibited by applicable law.
To access certain features you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
You must notify us immediately of any unauthorised use of your account. AllFans is not liable for any loss resulting from unauthorised use of your account before you notify us.
Creators are users who publish content on the Platform and receive subscription revenue from fans. By becoming a Creator, you additionally agree to:
AllFans pays Creators 80% of all subscription, tip, and pay-per-view revenue generated by their account, after payment processing fees. Payouts are made monthly, subject to a minimum threshold of $20. We reserve the right to withhold payment where there is evidence of fraud, chargebacks, or policy violations.
Fans subscribe to Creators and pay subscription fees to access content. Subscriptions are billed on a recurring monthly basis. By subscribing, you authorise AllFans to charge your payment method on a recurring basis until you cancel. You may cancel your subscription at any time through your account settings, effective at the end of the current billing period. Refunds are not provided for partially used subscription periods except where required by applicable law.
You are solely responsible for all content you upload, post, or transmit through the Platform. You agree that you will not upload or distribute content that:
AllFans reserves the right to remove any content that violates these standards without notice and to suspend or terminate the accounts of repeat violators.
You retain ownership of all content you upload to the Platform. By uploading content, you grant AllFans a non-exclusive, worldwide, royalty-free licence to host, store, display, and deliver your content solely for the purposes of operating the Platform. This licence terminates when you delete the content or your account.
The AllFans name, logo, and trademarks are the exclusive property of AllFans Platform. You may not use them without our prior written consent.
Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to our data practices as described therein.
Payments are processed by third-party payment processors. By providing payment information, you authorise AllFans and its payment processors to charge your payment method for applicable fees. AllFans is not responsible for errors or failures caused by payment processors.
You agree not to: reverse engineer, decompile, or disassemble any part of the Platform; use automated tools to scrape, index, or harvest content without permission; attempt to gain unauthorised access to any systems or accounts; interfere with or disrupt the integrity or performance of the Platform; or use the Platform to conduct any unlawful activity.
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied. AllFans does not warrant that the Platform will be uninterrupted, error-free, or free of viruses. To the fullest extent permitted by law, AllFans disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by applicable law, AllFans and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform. Our total aggregate liability to you for any claims arising from these Terms or your use of the Platform shall not exceed the greater of $100 or the amount you paid to AllFans in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless AllFans and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your content, your violation of these Terms, or your violation of any rights of a third party.
AllFans may suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by contacting us at our support page. Upon termination, your right to use the Platform ceases immediately.
These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Los Angeles County, California.
